1. Who we are
JEM Digital is a one-person digital agency owned and operated by Eric Rodgerson from Summerside, PEI. We build and maintain WordPress websites for small businesses.
2. What this policy covers and the law that applies
This policy explains what personal information we collect, why, how we use/protect it, and your rights.
Because JEM Digital operates from Prince Edward Island, and PEI has not enacted its own private-sector privacy law substantially similar to the federal legislation, PIPEDA (the Personal Information Protection and Electronic Documents Act) governs our handling of personal information in commercial activity. We also comply with CASL (Canada's Anti-Spam Legislation) for email. If you're outside Canada, your own jurisdiction's laws may also apply.
"Personal information" = information about an identifiable individual — name, email, phone, or the content of a message you send us.
3. Information we collect
3.1 Browsing (technical). Our hosting provider and security tools record your IP address and approximate location, browser/device type, pages visited, and referrer. Used to operate/secure the Site and understand usage. Not used for advertising profiles.
3.2 Contact/quote forms (Forminator). Typically name, email, and message (plus company/project details if you choose). We also receive your IP address and timestamp for spam protection.
3.3 Chat assistant. The Site's chat helps visitors learn about us and clients get support.
- Public chat (not logged in): processed in real time; public conversations are not stored — we keep no log. If you choose to share contact details, those become a lead (3.4).
- Client support chat (logged in): retained so we can provide/improve support and summarized for weekly reporting. Message tone may be assessed internally (e.g., urgency/sentiment) so urgent issues reach the right person.
Important: the public chat is an AI assistant, not a human. Messages are processed by an AI service on our behalf (Section 7). Don't share sensitive info (passwords, health data, financial account numbers) in chat.
3.4 Website leads. When you ask us to follow up (chat or form), we keep a lead record — name, email, company, what you need, IP, source — to contact you about your inquiry.
3.5 Client accounts. If we give you a login, we hold the account details needed to serve you.
3.6 Cookies & similar. The Site uses them to work and stay secure:
- WordPress/security cookies (login sessions, WP Defender);
- CleanTalk cookie + IP use for spam bot detection;
- Chat assistant keeps a temporary token in browser session storage (per-tab, cleared on tab close — no cross-site tracking);
- Forminator cookies prevent duplicate submissions.
We do not use advertising/cross-site tracking cookies and currently run no third-party analytics tracker (no Google Analytics). If that changes, this policy will be updated.
4. How we use your information
- To respond to you (chat, forms, leads, support); 2. To provide and improve services; 3. To protect the Site and users (spam filtering, abuse prevention, security); 4. To meet legal obligations.
We do not sell your information. We do not share it for advertising.
5. Consent
- Providing info through a form/chat/lead = voluntary consent to hear from us.
- We rely on express consent where required (e.g., email opt-ins) or implied consent where the purpose is obvious.
- You may withdraw consent anytime, subject to legal/contractual limits.
- Our emails are transactional and CASL-compliant; we don't send marketing email without your request.
6. AI and automated processing
- AI chat: messages are transmitted to the AI service to generate responses. Public messages aren't retained; client support messages are.
- Spam filtering: forms + public chat are checked by CleanTalk (content + IP reputation) to block spam. Only affects allow/block of a message.
- Support triage: internal automated tone assessment routes urgent client messages. It's a routing aid, not a decision about your credit/employment/etc.
We disclose AI use because you should know when you're interacting with automated systems — the chat always says it's an assistant.
7. Who we share information with (processors)
Processed on our behalf under our instructions, not for their own purposes:

No selling; no disclosure except where required by law.
8. Where your information is stored
Hosted by WPMU DEV; the AI platform operates infrastructure in Canada and/or the US. Information may be processed/stored outside PEI (other provinces, the US). We rely on providers bound by appropriate safeguards and protect your info per this policy and PIPEDA.
9. How long we keep information
Only as long as needed, then deleted or de-identified:
- Public chat messages: not retained (spam service may hold a transient record).
- Leads/inquiries: while following up + a reasonable period after; deletable on request.
- Client support conversations: duration of relationship + reasonable period after.
- Form submissions: reasonable period to respond/follow up.
- Backups: hosting auto-backups may briefly hold recently deleted data.
10. Security
HTTPS everywhere; WP Defender security software; spam filtering + rate limiting on forms/chat; admin access limited to the owner with key-based controls; we never store passwords you share in chat and never ask for sensitive info there. If a breach creates a real risk of significant harm, we'll notify you and authorities as required by law.
11. Your rights
- Access — ask what we hold and how it's used.
- Correction — fix inaccurate/incomplete info.
- Withdrawal of consent — anytime, subject to legal/contractual limits.
- Deletion — not a formal PIPEDA right, but we honour reasonable deletion requests except where legally required to keep records (tax, billing, etc.).
Respond within the legally required timeframe (normally 30 days), after verifying your identity.
12. Children
Not intended for children under 13; we don't knowingly collect from them. Contact us to delete if you believe otherwise.
13. Links to other websites
This policy applies only to jemdigital.ca; we're not responsible for other sites' practices.
